These Terms of Service ("Terms") govern your use of luvensi.com (the "Site") and any purchase you make from Luvensi ("we", "us", "our"). By visiting the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
1. Eligibility
You must be at least 18 years old, or the age of majority in your state, to place an order. By ordering you confirm that you meet that requirement and that the payment method you use is yours.
2. Products, descriptions, and images
We work to describe our products accurately. Colors may appear differently on different screens, and product photography is illustrative. Sizing is provided as guidance; if a pair does not fit, our Refund & Return Policy applies.
We reserve the right to limit quantities, to discontinue any product, and to refuse any order.
3. Pricing and errors
All prices are in U.S. dollars and may change without notice. Despite our efforts, a product may occasionally be listed at an incorrect price or with incorrect information. If an item's correct price is higher than the listed price, we will contact you before shipping to ask whether you want to proceed at the correct price or cancel for a full refund. We never charge you more than the price you agreed to without your consent.
4. Orders and acceptance
Your order is an offer to buy. We accept it when we send you a shipping confirmation. We may cancel or refuse an order — before or after confirmation — if we suspect fraud, if the product is unavailable, if there was a pricing error, or if the order violates these Terms. If we cancel an order you have already paid for, we refund you in full.
5. Payment
Payments are processed by Shopify Payments and the other providers shown at checkout. We do not store your full card number. By submitting payment information you represent that you are authorized to use the payment method.
6. Promotions and discount codes
Discount codes and promotions are valid only for the period and on the terms stated, cannot be combined unless we say so, have no cash value, and may be withdrawn at any time. Volume discounts apply automatically when the stated quantity is in your cart. We may void an order and refund it if a code was obtained or used in a way it was not intended.
7. Shipping and returns
Shipping timelines and delivery terms are set out in our Shipping Policy. Returns, refunds, and cancellations are set out in our Refund & Return Policy. Both are incorporated into these Terms.
8. Your account and accuracy of information
You are responsible for keeping your account credentials confidential and for the accuracy of the shipping and contact information you give us. We are not responsible for a delivery that failed because of an address you entered incorrectly.
9. Acceptable use
You agree not to use the Site to break any law, to infringe anyone's rights, to submit false information, to upload malicious code, to scrape or harvest data, to interfere with the security of the Site, or to place orders on behalf of someone else without their authorization. We may terminate your access for any of these.
10. Intellectual property
The Site, its text, graphics, logos, and layout are owned by Luvensi or our licensors and are protected by U.S. and international law. You may not copy, reproduce, or use them for commercial purposes without our written permission.
11. Third-party links and services
The Site may link to third-party sites and rely on third-party services. We do not control them and are not responsible for their content, products, or privacy practices. Your dealings with them are between you and them.
12. Reviews and submissions
If you send us a review, photo, comment, or suggestion, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and publish it in connection with our business. You confirm that the submission is yours and does not violate anyone's rights. We are under no obligation to publish or keep any submission.
13. Disclaimer of warranties
The Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, except those that cannot be excluded under applicable law. We do not warrant that the Site will be uninterrupted, secure, or error-free.
Nothing in these Terms limits your rights under the Federal Trade Commission's rules or your state's consumer protection laws.
14. Limitation of liability
To the fullest extent permitted by law, Luvensi and its officers, employees, and suppliers will not be liable for indirect, incidental, punitive, or consequential damages arising out of your use of the Site or any product. Where liability cannot be excluded, our total liability is limited to the amount you paid for the order in question.
Some states do not allow the exclusion of certain warranties or the limitation of certain damages. In those states our liability is limited to the greatest extent permitted by law.
15. Indemnification
You agree to indemnify and hold Luvensi harmless from any claim or demand, including reasonable legal fees, arising from your breach of these Terms or your violation of any law or third-party right.
16. Governing law and disputes
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in the State of Florida, and you consent to their jurisdiction. This does not prevent you from bringing a claim in small claims court or from filing a complaint with a consumer protection agency.
17. Severability and waiver
If any provision of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it.
18. Changes to these Terms
We may update these Terms at any time by posting a revised version on this page with a new "last updated" date. Changes apply to orders placed after they are posted. Please review this page periodically.
